North Carolina collateral source rule

Although Cary area residents are always watching out for other drivers and trying to avoid a car accident, sometimes there's just nothing that can be done. Dangerous drivers are everywhere, and they continue to engage in activities that can cause an accident in just mere seconds. North Carolina has a collateral source rule that may be of interest to those who have been involved in a car accident.

The North Carolina collateral source rule means that whatever compensation a person receives from insurance does not affect what they receive from damages they seek from another source. So if a person is injured by a negligent driver, the victim may be able to recover compensation from their insurance and they may be able to file a lawsuit against the negligent driver. Whatever compensation they receive from their insurance will not have an effect on whatever damages they are able to recover from the negligent driver.

A legal professional who is skilled in personal injury can help their client who has been the victim of a serious car accident. An attorney can investigate the circumstances surrounding the accident and help get the answers a victim deserves about what happened. An attorney understands the victim is now facing emotional trauma, property loss and unexpected financial loss because of the accident. An attorney will work hard to make sure their client receives the help they need and deserve. Compensation may be available for medical expenses, pain and suffering, lost wages and other damages.

Unfortunately, car accidents happen every day in North Carolina. Most of these accidents are not serious but when a family has been affected by a negligent driver they have the legal right to hold them responsible.
